Yet I shoul think this circumstance alone, cannot form a suffi. cient ground, for considering the Mouzha or the lands under reference to belong to Punchannagram for estate Hoozurmal has been resumed as Lawaris property to which the right of Government no doubt extends, wherever it may be situated. 5th. On the other side, the lands are not also mentioned in the chittahs of 1 19o B. S. of Pur. gunah Khaspur. This would tend to the claim of the occupants, but then they say—as Mouzah Kalighat entirely consisted of rent-free lands, which have from time immemorial, been dedicated to the Sheba of Kali, they were excluded from the measurement of 1190 B. S. as unfit for assessment. This does not seem improbable, for had the Mouzah been left unmeasured in 1190 B. S. from the consideration that it belonged to Punchannagram, it would come under measurement in 1200 B. S. From the Collectorate and Civil Court Fysalas and Roobkaris which have been produced by the occupants, from the Sunnunds &c shewn by the collectorate record-keeper, agreeably to all the local enquiries held by me in person and from the deposition of several witnesses, which have been taken down, it would appear, that the lands of Mouzha Kalighat belong to Purgunah Khaspure. 6th. Under this circumstances, therefore, I have excluded the lands from assessment subject to confirmation of higher authorities. My verhacular proceedings dated 7th Instant, herewith accompany and will furnish any further information on the subject that may be required, د مو t I have &c. (Sd.)
