( ৩৬৪ ) Mauritius from the ports of Calcutta, Madras and Bombay respectively, in compliance with the Provisions hereinafter mentioned, but not otherwise III And it is hereby enacted, that at ench of the three ports fores ud it shall be liwful for the Government of the Presidency within which the port is situ attd to authorize the persons iromın vted by the Gov. 1 minent of M uritius, under the order hereinbefore inscried to a t as langr it ion Agents at the aforesaid ports respectively, and to exercise the powers conferred on I migration Agents by this Aut monthly reports to the Government to which he is Aud every such Limigration Agent shall mak, subordın'ıte of all matters transıcted bylııım ın pursuance of this Act IV And it is hereby en \cted that it shill not be lawful to convey any Emigrant, being a Native of India, who may cimbark for the purpose of la bouring for hire in the Colony of M iuritius from either of the ports afores ud, in any Ship or Wessel, uuli ss a Licence be obtained for carrying Emigrants in such Ship or Vessel from the Government of the Presidency in which the port is situate A fee of Rupees slı ill be demand ble in respect of every such Licentle, aud tht gi auting or withliold ing the Sanud sh ill be Cntirely discretion try with the Govurnment, and ın consıderatıon of su( h Licence the Master of Cvery Ship convoying or destined to convey Emigrants from India shall execute a Bond, binding himself nud his owners iu a penal sum of 10,000 ltupees to onform to the several conditions hereunder provided, and the said Bond shall be executld in duplic te that it may be put in sult either at the place of execution or in the Colony of Mauritius and one copy shall be forwarded to the Government of Mauritius to be dealt with as the case may require And every Ship or Wessel in which any such Dmigrant shall be conveyed without a Licence being obtained as aforesaid shall be liable to be forfeited, and the Master thereof shall be luable as for a misdemeanqr in a fine of 1,000 Rupees for every such Emigrant so illegally conveyed W And it is hereby enucted, that it shall not be lawful for the Master of any Wessel licenced as above to rective on board any Dmigrant labourer as above provided unless such labourer shall have in bis possession and show a Certificate or puss to be given to him by the Dmigration Agent of the port stating his name and the name of his father and his age, and certifying th it having appeared before auch Agent he has duclared his willingness and de sire to proceed to work for lure in the said Colony of Mauritius
VI And it is hereby enticted that before any Ship or Wessel, so licenced to carry Emigrant la bourers as above provided, shall be cleared out from any of the aforesaid ports foi the Mauritius, 1t shall be necessary for the Master of such Ship or Vessel, Provided any Imigrant of the description aforcsaid এবং তথায় তাহারদিগকে লইয়া যাইতে অনুমতি হই বেক কিন্তু এই আইনেব বিধানের অন্যমতে তাহার। যাইভে পাবিবেক না ইতি । ৩ বাৰ। এবং ইহাতে হুকুম হইল যে পূৰ্ব্বোক্ত বিধা নানুসাবে যে২ ব্যক্তিকে মবিচেব গবরনর সাহেব নিযুক্ত কবে ন উক্র তিন বন্দবেব প্রত্যেক বন্দৰ যে বাজ ধানীব মধ্যে থাকে সেই বাঞ্জধানীৰ গবৰ্ণমেন্ট সেই ১ ব্যক্তিকে উক্ত বন্দরে দেশান্তবে গমনের কার্য্যেৰ এজেন্টী কর্ম কবিতে এবং এই আইনেব দ্বাৰা এজেন্টেব প্রতি যে ক্ষমতাপণ হইয়াছে তদনুসাবে কার্য্য কবিতে হুকুম দিতে পাবেন । এবং ঐ দেশান্তবে গমনেব কার্য্যেব প্রত্যেক এজেন্ট যে গবৰ্ণমেন্টেৰ অধীনে থাকেন সেই গবর্ণমেন্টেব নিকটে এই আইনানুসাবে কব র্তাহাব সমস্তু কার্য্যের রিপোর্ট মাসে ২ করিবেন ইতি । ৪ ধাবা । এবং ইহাতে হুকুম ছইল যে যে বাজধ। নীব মধ্যে বন্দব থাকে সেই বাজধানীব গবৰ্ণমেন্টেব স্থানে কোন জাহাজ দেশান্তব গমনকাৰি ব্যক্তিকে লইয়া যাইবাব নিমিয় পবওয়ান না পাইলে ঐ জাহাঞ্জে সেই বন্দবহইতে মৰিচ উপদ্বীপে মজবী কবিবাব নিমিত্ৰ ভাৰত বর্ষজাত দেশান্তব গমনকাবি ব্যক্তিবদিগকে লইঘ1 যাইতে নিষেধ হইল। ঐ প্রত্যেক পবওয়ানাৰ নিমিত্ত্বে এত টাকা রসুম দিতে হইবেক এবং গবৰ্ণমে ট আপন বিবেচনাক্রমে ঐ পব ওযান দিতে স্বীকৃত বা অস্বীকৃত হটতে পাবেন । এব^এ পবওয়ানা পাইবাব নিমিত্ত ভারতবর্ষ হইতে দেশ। স্তব গমনকাৰি ব্যক্তিরদিগকে যে প্রত্যেক জাহাজ লইয যায় বা লইয়া যাওনার্থ ভাড়া হয় ঐ প্রত্যেক জাহাজেৰ অধ্যক্ষ এক বগু অর্থাৎ তম সুক লিখিয়া দিবেন ও সেই বণ্ডে এমত লেখা থাকিবেক যে ঐ জাহাজেৰ অধ্যক্ষ কিম্বা তাহার মালিক এই আইনের পশ্চাৎ লিখিত নানা নিয় মোৰ মতাচৰণ না কবিলে তিনি দশ হাঞ্জাব টাকা ফ্রবীমানা দিবেন । এব^ যে স্থানে ঐ ব&েদস্তখৎ হয় সেই স্থানে অ থবা মৰিচ উপদ্বীপে ঐ বগু দুষ্টে নালিশ হইবাব নিমিত্ত ঐ প্রকাৰ দুই খান বওে দস্তখং কবিতে হইবেক এবং তাহার একথান মবিচ উপদ্বীপের গবর্ণমেন্টেব নিকটে প্রেরণ করা যাইবেক এব^ তাহাবা সেই বিষয়ে যাহা আবশ্যক হয় ভfহাই কবিবেন । এষ৭ যে সকল জাহাজের বিষয়ে পূৰ্ব্বোক্তমতে পরওয়ান না দেওয়া গিয়া থাকে তাহাতে যদি জাহাজ্ঞাধ্যক্ষ কোন দেশাস্তুর গমনকাবি ব্যক্তিকে লইয়া যান তবে ঐ জাহাজ জব্দ হইবেক এবং জাহাজের অধ্যক্ষ দেশাস্তুর গমনকাবি যত্ত ব্যক্তিকে ঐ রূপ বেআইনমন্তে লইয়া যান তাহার দেব জন প্রক্তি হাজার টাকা করিয়া গুনাহগাৰী দিবেন ইতি । ৫ ধারা। এবং ইহাতে হুকুম হইল যে দেশান্তৰ গমনকাবি ষে মজুরের নিকটে ঐ বন্দরের দেশান্তরে গমনের ব্যাপাবে ব এজেন্ট সাহেবেৰ দেওয়া সর্টিফিকট কিম্বা পাস না থাকে এব^ সে ব্যক্তি তাহা দেখাইভে ন! পাৰে এমত্ত মজুরেৰদিগকে পবওয়ানাপ্রাপ্ত জাহাজের অধ্যক্ষ আপন জাহাজে সইতে পারিবেন না। ঐ সর্টি ফিকটেব মধ্যে ঐ মজুরের নাম ও তাহাব বাপেৰ নাম ও জাহার বয়-ক্রম লেখা থাকিবেক এব^ তাহাতে আবে। টহা লেখা থাকিবেক যে ঐ মজুর ঐ এজেন্ট সাহেৰেৰ সমুখে উপস্থিত হইয়া ঐ মরিচ উপদ্বীপে বেতনের নিমিত্ত খাটিতে জথায় যাইত্তে আপনার সমত্তি ও ইচ্ছ। জ্ঞানাইয়াছে ইতি । ৬ ধাবা । এবং ইহাতে হুকুম হইল যে পূৰ্ব্বোক্তমতে দেশান্তৰ গমনকাবি মজুবেৰদিগকে লইয়া যাইতে ষে জাহাজকে পরওয়ানা দেওয়া যায় সেই জাহাজ পূৰ্ব্বোক্ত কোন বন্দবহইতে মরিচ উপদ্বীপে যাত্রাকরণের পূৰ্ব্বে যদ্যপি সেই প্রকার দেশাস্তুৰ গমনকারি কোন ব্যক্তি তাহাতে আরোহণ কবিয়া থাকে তবে ঐ জাহাজের অধ্য shall embark therein, to obtain from the Emigra i cvg আবশ্যক যে ঐ বন্দরে নিযুক্তহওয়৷ ও ক্ষমত্তাপ্রাপ্ত [গবণমেন্ট গেজেট ১৮৪২। ১৯ জুলাই ]
