( ७१* ) cal lımıts, to appear before hım ın person or by duly constituted Attorney within areasonable time, not being less than one month from the date of the notification at whatever place within the said limits his office may be held, with all Pottahs Ground rent Bills, Bills of Sale and other writ ings in virtue of which they may own or occupy such lands and to attend him from day to day dur ing his enquiries II And it is hereby enacted, that the said Officer shall for the purposes of this Act have full power and authority at all seasonable hours in the day time to enter or to direct his subordinate Officers to enter into and upon any land or tent ment within the said local limits and in and upon the land on which any house, building or other erection is built or building or intended to be built and into and upon any buildings or any part thereof without being liable to any action at law or suit in Equity or any other legal proceedings or molestation whatsoever for or on account of such entry or of any thing done or to be done in any part theruof um pursuance of this Act Pro vided that such Officer or Subordinate Officers shall not enter upon any lands or tonements which may be occupied at the time unless with the con sent of the occupier thereof, without previously giv ing the said occupier reasonable notice of his or their intention to do so III And it is heleby enacted that if any per son at any time shall obstruct or milest the said Officer or any of his Subordinate Officers in the performance and execution of his or their duty or any thing which they are required to do by or by virtue or in consequence of this Act every such person so offending shall on conviction before a Magistrate for the Town of Calcutta forfeit and pay for every such offence any sum not exceeding 200 Rupees IV And whereas such notification as is dureut ed by Sectıon I of thıs Act may not ın all cast s be effectual it is therefore hereby enacted that it shall be lawful for the Surveying Officer to cause any person owning or occupying lands or tenements within the said local limits to be served with a special notice under his official seal and signature stating the purpose for which the attendance of such person is required and any document which such person is to bring with him and the period within which such person is to attend and if such person cannot be found the ভঁাচাৰ নামে কোন নালিশ কষ্টতে পাবে না অথ বা তাহাব প্রতিকুলে আইনসম্পৰ্কীয় অন্য কোন কাৰ্য্য বা ব্যাঘাত হইতে পাবিবেক না । কিন্ত জানা কৰ্ত্তব্য যে হাদি ঐ ভূমি বা বাটীতে তৎসমযে কোন ব্যক্তিৰ দখল থাকে তবে তাহাৰ দখলকাবেব অনুমতি না পাইলে অথবা প্রবেশ কবণের মানসেব উপযক্ত এয়েল। উক্ত দণ্ডীলকাৰ কে ন দিলে ঐ কর্মকাবক কি তাহাব ভাবেদাব আমলা ঐ ভূমি অথবা বাটীতে প্রবেশ কৰিতে পারিবেন নাটতি । ১ বাবা । এবং ইহাতে চকুম উক্ত কর্মকাৰককে অথবা "হাব ভাবেদাৰ আমি লাবদিগকে অববোধ করে কি উত্তাক্ত কবে তবে সেই অপবাধি ব্যক্তিব দোষ শতব কলিকাতাৰ কোন মাঞ্জি স্ট্রেট সাহেবের সমুখে সাব্যস্ত হটলে প্রত্যেক অপৰ ধেব নিমিত্ত্বে সেই ব্যক্রি ২ ১ টাকাৰ অধিক না হT এমত জবঁীমান দিবেক ইতি । ৪ ধারা । এবং যেহেতক এমত কষ্টতে পাৰে যে এই আইনেৰ ১ ধাৰাব নিরূপিত এক্কেল প্রত্যেক গতিকে সফল হইবেক ন৷ অতএব ইহাতে হুকুম হইল যে জরিপ কবণিয় কর্মকাৰক উক্ত বিশেষ সীমাব মধ্যে ভূমি ল বাটীৰ মালিক কি দৰ্খীলকাব ব্যক্তিকে আপনাব পদে পলক্ষে মোহব ও দস্তখণ্ডযুক্ত এক বিশেষ এক্সেল দিতে পাবেন এব^ যে নিমিত্তে ঐ ব্যক্তিকে হাজিরহ ওrনব হুকুম চষ্টয়াছে তাহ এবং যে দলীল ঐ ব্যক্তির আপ নাব সঙ্গে আনিতে হইবেক তাছা এবং যে মিয়ানেৰ মধ্যে তাহাৰ হাজির হইতে হইবেক তাছা ঐ এৱেলান। মাতে বিশেষ কবিয়া লেখা থাকিবেক এবং যদি সেই ব্যক্ৰিকে না পাওয়া যায় তবে তাহাৰ সামান্য বাসস্থানে ঐ এঞ্জেলা লটকান যাইবেক ইতি । ৫ ধাৰা । এবং ইহাতে হুকুম হটল যে ঐ জবিপলব ণিয় কর্মকাবকের সম্মুখে কোম ব্যক্তিব স্বয২ উপস্থিত হইতে অথবা ৰীতিমত কোন মোপ্তারকে নিযুক্ত কৰিতে আইনসিদ্ধ তলব হইলে যদি সেই ব্যক্তি তাহা না ম'নে কি উক্ত কর্মকারক যে দলীল দাখিল কৰিতে ভকম দেন তাহা দাখিল না কৰে অথবা ঐ কর্মকাৰক অ ইনসিদ্ধt যে জিজ্ঞাসা করেন তাহার উত্তব না দেয় তবে ঐ কর্মক রকেৰ এই মত্ত ক্ষমতা থাকিবেক যে ঐ ব্যক্তি যজ্ঞ কাল এইর প জটি কৰে ভক্ত কাল দিন ১ দশ টাকায় অধিক না V And it is hereby enacted that if any person shall wilfully omit to obey any lawful summons to attend before the Surveying Officer personally or by duly constituted Attorney or to produce any document which he is required by the said Officer to produce “or to answer any lawful question put by the said Officer it shall be competent to the said
