{ , २१6 tive of India any contract for labour to be performed in any British or Foreign Colony without the Territories of the East India Company, or who should knowingly abet or aid any Native of India in emigrating from the said Territories for the purpose of being employed as a laborer, should be liable on conviction before a Magistrate or Justice of tho Peace, to a fino not exceoding 200 Rupees for every Native so contracted with, aided or abetted, and in default of payment of such fine, should be liable to be imprisoned for a term not exceeding three months : Provided always, that nothing in that Act contained should be taken to apply to any Native Seaman who should of his own free, will contract to navigato any vessel, or who should embark on board such vessel in pursuance of such contract, or to any person who should contract to serve as a menial servant only, or who should embark as such menial servant : And whereas the Island of Ceylon geographically, historically and socially considered, is analogous to the countries subject to the Government of the East India Company: It is hereby enacted, that Act XIV of 1830, in so sar as it makes liable to penalties every person who shall make with any Nativo of India any contract for labor to be performed in the said Island, or who shall knowingly aid or abet any Native of India in emigrating from the Territories sulject to the Government of the East India Conlpany to the said Island, is repealed. 1 I. But, whereas the sail Island is not subjcet to the Legislative power of the Governor General of snilia in Council, so that the said Governor Goneral in Council is unable to make Laws for the protection of such Natives of India as may emigrate to the said Island against the evils which might attend the emigration of such Natives of sndia from the said Island to any loritish or Foreign Co lony : It is therefere hereby enacted, that this Act shall not come into operation until the Governor General of India in Council shall be duly certified that the Legislature of the said Island has made such laws as the sail Governor General in Council shall think sufficient for the protection of such Natives of India so emigrating to the said Island, against the evils aforesaid, and shall notify in the Guzette that he has been so certified. [Gorernment Gazette, 25th May, 1847.] |s | ) জ্যের বাহিরে কোন ইদগঞ্জীয় কি ভিক্ষাধিকারির বসতিতে কর্ম করিষার নিমিত্তে ভারতবর্ষীয় কোন ব্যক্তির সহিত যে কেহ চুক্তি করিবেক কি মজুরের ন্যায় খাটিবার নিমিকে ঐ রাজ্যহইতে ভারতবর্ষীয় কোন ব্যক্তিকে গমনার্থে জানিয়া শুনিয়া প্রবৃত্ত্বি দিবেক বা তাতার সাহায্য করিবেক সেই ব্যক্তির অপরাধ কোন মাজিষ্ট্রেট কিম্ব জুটিঙ্গ অফ দি পীস সাহেবের সমীপে সাব্যস্ত হইলে এদেশীয় যে প্রত্যেক ব্যক্তির সঙ্গে চুক্তি করিয়াছে কি খাহার সাহায্য করিয়াছে বা যাহাকে প্রবৃত্ত্বি দিয়াছে সেই প্রত্যেক ব্যক্তির নিমিত্রে ঐ অপরাধি ব্যক্তি ২৭ •১ দুষ্ট শত টাকার অনধিক জরীমানার যোগ্য হইবেক এবং ঐ জরীমানায় টাকা না দেওয়া গেলে ৩ ভিন মাসের অনধিক মিয়াদে কয়েদ থাকনের যোগ্য হইবেক ইতি । কিন্তু এদেশীয় যে কোন নাবিক স্বেচ্ছাক্রমে কোন জাহাজের কর্ম করিতে চুক্তি করে কি সেই চুক্তির অনুসারে সেই জাহাজে আরোহণ করে কিম্বা যে কেহ কেবল দাস্য কর্ম করিতে চুক্তি করে অথবা সেই প্রকার দাসের ন্যায় জাহাজে আরোহণ করে সেই ২ ল্যক্তির উপর এই আইনের লেখা কোন কথ) যে খাটে এমত বোধ করিতে হইবেক মা । - এবং যেহেতুক সিংহলদ্বীপ ভূগোলসম্পর্কে ও পুরাবৃত্ত সম্পর্কে এবং জাতিসম্পর্কে কোম্পানি বাহাদুরের শাসিত দেশের সদুশ অতএব ইহাতে হুকুম হইল যে ঐ দ্বীপে কৰ্ম করিবার নিমিত্ত্বে ভারতবর্ষীয় কোন >্যক্রির সঠিত যে ব্যক্তি কোন চুক্তি করে কি কোম্পানি বাহাদুরের শাসিত দেশহইতে উক্ত দ্বীপে গমনার্থ কোন যুক্রিকে জামিরাস্তুনিয়া প্রবৃত্ত্বি দের বা তাহার সাহায্য কয়ে সেই ব্যক্তি ১৮৩৯ সালের ১৪ অrষ্টমের মে ভাগের দ্বারা দণ্ডের যোগ্য হয় সেই ভাগ রদ হইল ইতি । ২ ধারা। কিন্তু যেহেতুক উক্ত দ্বীপ ভারতবর্ষের খ্ৰীযুত গবরনর জেনরল বাহাদুরের হজুর কৌন্সেলের ব্যবস্থাপক ক্ষমতার অধীন নহে এবণ, ভারতবর্ষের যে লোকের ঐ দ্বীপে গমন করে ভারতবর্ষের ঐ লেকেরা ঐ দ্বীপহইতে কোন ইঙ্গলওঁীয় বা ভিমাধিকার দেশীয় বসতিতে গমন করিলে যে অপকার হইতে পারে তাহাহইতে তাহারদিগকে রক্ষা করণার্থ উক্ত প্রযুত গলরনর জেনরল বাহাদুর হজুর কোসেলে আইন কfরতে পারেন না অতএব ইহাতে হুকুম হইল যে যাবৎ খ্ৰীযুত গবর্নর ঞ্জেনরল বাহাদুরকে হজুর কৌন্সেলে এই মত জ্ঞাত না করা যায় যে এ দ্বীপের ব্যবস্থাপক কৌন্সেল ঐ দ্বীপে গমনশীল ভারতবর্ষের ঐ লোকেরদের পূৰ্ব্বোক্ত অনিষ্টহইতে রক্ষার জন্যে প্রযুত গবরনর জেমরঙ্গ বাহাদর হজুর কৌন্সেলে যে ২ আইন উচিত বোধ করেন সেই2 আইন নির্দিষ্ট করিয়াছেন এবং সেইরূপ সম্বাদ পাইবার বিষয়ে গেঞ্জেটে এক্সেল না দেন ভাবহ এই আইন আমলে আসিবেক না ইতি । হুকুম চইল যে এক্ষণে পাঠকরা মুসাহিদা সৰ্ব্ব সাধরণ লোককে ফ্রানাইবার নিমিত্তে প্রকাশ হয় । হুকুম হইল যে আগামি ১৫ আগষ্ট তারিখের পর ভারতবর্ষের ব্যবস্থাপক কৌন্সেলের প্রথম ষে বৈঠক হয় তাহাতে এই মুসাবিদা পুনরায় বিবেচনা করা যায় । জি এ বুশবি । ভারতবর্ষের গবর্ণমেন্টের সেক্রেটারী। John C.
