( ७१ 8 vernment of.Bengal, or by the Magistrates of Calcutta, or by the said Commissioners, shall be the property of, and are hereby vested in the said Commissioners as Trustees aforesaid. VIII. And it is enacted, that it shall be lawful for the said Colmmissioners, with the consent and approbation of the Government of Bengal, to pave and water such of the streets, public ways and pub. lic thoroughfares existing in the said Town at the time of the passing of this Act, or at any future time as they shall think fit. IX. And it is enacted, that the said Commissioners shall keep in sufficient repair every street, public way and public thoroughfare existing in the said Town at the time of passing this Act, or at any future time, and shall be liable to be indicted for not sufficiently repairing the same. X. And it is enacted, that if any person shall displace, take up or make any alteration in the pavements, flags or othor materials of any foot or carriage way in any street within the said Town, without the consent in writing of the said Commissioners, or of their said Surveyor, or shall cause any obstruction to, or make any encroachment upon any street in the said Town, any such person so offending shall for every such offence on conviction before a Magistrate forfeit and pay a sulu not exceeding Tifty Rupees. XI. Antl whereas it is essential to the health and convenience of the inhabitants, that straight and spacious streets and thoroughfares should be continued where they have been begun, and should be opened at convenient and suitable distances where such do not at present exist so as to perforate the mass of buildings within the said Town in straight lines as nearly as may be from South to North, and from East to West, crossing each other at right angles, and from South oast to North West and from South West to North East, crossing the straight lines abovementioned diagonally with large open spaces forming squares or circles at convenient and suitable distances, from whence the said streets may conveniently divergo in lines without interruption to the river aud to the open country without the said Town, so far as the completion of such plan may be practicable, and where not entirely practicable upon a plan as nearly approaching to such plan as may be : And whereas it is also expedient and necessary that the narrow lames and gullys which compose the greater part of the said Town inhabited by the Native inhabitants' shall be converted into such straight and spacious streets and thoroughfares formed as abovementioned, due regard being had to the compensation of Owners of houses, buildings and grounds, which may be required to be vested in the said Commissioners for any such purposes as aforesaid : It is enacted, that as soon as may be after the passing of this Act, the said Commissioners shall cause plans to be made by their said local Surveyor and by other competent Surveyors, shewing the di [গবর্ণমেণ্ট গেজেট । ১৮৪৭ । ২১ ডিসেম্বর } 線 ) ty গাথনি ও এমারও ও সরঞ্জাম ও ছাতিয়ার অথবা অন্য जुदा कङ्गा यात्र ठाइ! श्रृंरीख् প ঐ কমিস্যনরেরদের সম্পত্তি হইবেক এবং সেই সকল বিষয়ের স্বতন্ত্র उँीशांङ्ग८मङ्ग टूडि इशाङ्ग चांद्भा चार्श्वभ होइशारछ इडि । ৮ ধারা । এবং ইহাতে হুকুম হুইল যে এই আইন জারী হওনের সময়ে উক্ত শহরে যে রাস্তা ও সরকারী পথ এবং সরকারী খোঙ্গ পথ থাকে বা উত্তর কালে করা যায় তাহার মধ্যে যে রাস্তু ইত্যাদির বিষয়ে উপযুক্ত বোধ হয সেই রাস্তুাষ্ট্ৰত্যাদিতে উক্ত কমিসানরেরা স্নাজল দেশের গবর্ণমেন্টের সমতি ও অনুমতিক্রমে শান করিতে পারেন এবং জাহাতে জঙ্গ দিতে পারেন ইতি । ৯ ধারা । এব^ ইকাতে হুকুম হটল ষে এই আইন জারী হওনের সময়ে উক্ত শহরে যে প্রভোক রস্থিা ও সরকারী পথ ও সরকারী খোলা পথ থাকে কিম্বা উত্তর কালে করা যায় সেই প্রত্যেক রাস্তাপ্রভূতি উক্ত কমিসানরের উপযুক্তমতে মেরামৎ করিবেন এবং উপযুক্তমতে মেরাম, না করিলে তঁছিারদের নামে নালিশ হইতে পারে ইতি । ১০ ধারা । এবং ইহাতে হুকুম হটল যে উক্ত শঙ্করের মধ্যে কোন রস্থিায় পদব্রজে যাওনের বা গাড়ি যাওনের পথের কোন শান কি পাতর অথব1 অন্য সরঞ্জাম যদি কোন ব্যক্তি উক্ত কমিস্টনরেরদের কিম্ব তাহারদের উক্ত সরবেয়রের লিখিত অনুমতি বিনা সবায় বা তুলিয়া ফেলে বা তাহাতে কোন ফেবফার করে অথবা উক্ত শহরের কোন রাসু কোন প্রকারে অবরোধ করে বা তাহার উপর কিছু গাথে তবে এষ্টমত প্রত্যেক অপরাধি ব্যক্তির দোষ মাঞ্জিষ্ট্রেট সাহেবের নিকটে সাব্যস্ত হইলে প্রত্যেক অপরাধের জন্যে তাহার ৫ • N টাকার অনধিক জরীমান হইলেক ইতি । ১১ ধারা । এবং মেকেতুক শহবনিবাসিনদের স্বাস্থ্যের এব^ উপকারের জন্যে অfবশ্যক অাছে সে যে সিধা ও চৌড় রাস্থা ও খোলা পথ আরম্ভ হইয়াছে তাহ। সম্পন্ন চয় এবং যেখানে এই সমযে এই মত রাস্তাপ্রভৃতি না থাকে সেই খানে উপকারক এবং উপযুক্ত অন্তরে সেই প্রকার রাস্তু। এমত করা য’য যে ঐ শহরের মধ্যে স্থান এমারতের মধ্যদিয়া সেইরূপ সিধা পথ করা যায় অর্থাৎ, সাধ্যপৰ্য্যস্ত ঢেরাকৃতিরূপে দক্ষিণঅবধি উত্তরপর্য্যন্ত এব^ পূৰ্ব্ব অবধি পশ্চিমপৰ্য্যন্থ ঐ রাস্তাৱ পৰন হয় এবং দক্ষিণ পূৰ্ব্ব অবধি উত্তৰ পশ্চিমপৰ্য্যন্ত এবং দক্ষিণ পশ্চিমঅবধি উত্তরপূৰ্ব্বপৰ্য্যপ্ত অন্য রাস্থ কোণাকোণি রেখারূপে বিদিগে নির্মাণ হয় এবং উপকারক ও উপযুক্ত অস্তরে বৃহৎ শূন্য স্থান থাকে এব^ সেই *भून7 झाएन्र চতুষ্ণেকাণ বা গোলাকৃতি চক থাকে এবং উক্ত চকহইতে ঐ২ রান্ত উপকারকমতে প্রতিবন্ধকবিন ঋজুরে থা ক্রমে এক দিগে গঙ্গাপর্য্যন্ত যায় অপর জিগে উক্ত শহরের বাহিরের ময়দানপর্য্যস্ত ধায় এবং এই প্রকার পাংC哥 র সাধ্যপৰ্য্যন্ত ঐ২ কর্ম সম্পন্ন করা যায় এব4 সম্পূর্ণরূপে তাহা হইতে ন পারিলে এই পাণ্ডুলেখ্যের সদুশ যেপর্য্যন্ত সাধ্য সেই পৰ্য্যন্ত তাঙ্ক করা যায় এবং যেহেতুক উচিত এবং আবশ্যক আছে যে উক্ত শহরের এদেশীয় সোকের যে স্থানে বাস করেন সেই স্থানে যে শুড়ি ও গলি পথ আছে তাহার পরিবর্ষে পূৰ্ব্বোক্তমতে সোজা এবং চৌড় রাস্তু ৪ খোলা পথ নির্মাণ হয় এবং যে ঘর ও এমারৎ ও ভূমি পূৰ্ব্বোক্ত অভিপ্রায়ের জন্যে উক্ত কমিস্যনরেরদের প্রতি অর্পণ করণের আবশ্যক হুইবেক সেই ঘরপ্রভূতির স্বামিরদিগকে উপযুক্তমতে ক্ষতিপূরণ করিয়া দেওয়া উচিত। অতএব ইহাতে হুকুম হইল যে এই আইন জারী হওনের পর ষত শীঘু সাধ্য উক্ত কমিসানরের আপনারদের উক্ত বিশেষ সরবেয়ার এবং অন্য কোন উপযুক্ত সরবেয়রের স্থার নকশা প্রস্তুত করাইবেন এবং ঐ
