কাস্তবাবু Հե Տ হেস্টিংস কিংবা র্তাহার কোনও লোক লইয়াছিলেন কি না, এই কথা কাউন্সিল হইতে জিজ্ঞাসা করা হইলে নন্দকুমার উত্তর দেন যে, বেগম কাস্তবাবুর দ্বারা তাহ পেশ করিতে বলেন, কাস্তবাবুকে মূল পত্র না দেওয়ায়, তিনি ইহার নকল লইতে চান। নন্দকুমার তাহার সমক্ষে নকল করিতে বলেন ; সে দিন সন্ধ্যা হওয়ায়, তৎপর দিন লইবার কথা হয় ৩৮ কাউন্সিল হইতে এই সমস্ত বিষয়ের প্রমাণের জন্য কান্তবাবুকে সমন দেওয়া হয়, কিন্তু হেস্টিংসের নিষেধক্লমে তিনি প্রথমে উপস্থিত হন নাই । সুতরাং কাউন্সিলের সভ্যেরা নন্দকুমারের উপস্থাপিত অভিযোগ-সম্বন্ধে আপনাদের বিবেচনানুযায়ী বিচার নিম্পন্ন করেন । অনন্তর কাউন্সিলের অবমাননার হেতুপ্রদর্শনের জন্য পুনরায় কান্তবাবুর নামে সমনপ্রেরণের জন্য কাউন্সিলে তর্কবিতর্ক উপস্থিত হয়। বারওয়েলসাহেব প্রথমে আপত্তি করেন। গবর্নর জেনারেল হেস্টিংসসাহেব তাহাকে কলিকাতার সর্বপ্রধান দেশীয় অধিবাসী বলিয়া, উল্লেখ করিয়া বলেন যে, সাধারণ বেনিয়ানদিগের ন্যায় তিনি গণ্য হইতে পারেন না । এই সময়ে তিনি কাস্তবাবুর বংশমর্যাদার কথাও উল্লেখ করিয়াছিলেন। ক্লেভারিংসাহেব তাহাকে সাধারণ বেনিয়ানগণ হইতে বিভিন্ন মনে করেন নাই এবং প্রকাশ করেন যে, কান্তবাবু যখন কোম্পানীর ইজারদার, তখন তিনি কাউন্সিলের আদেশ মানিতে বাধ্য ৩৯ বারওয়েলও তখন ইহাতে মত দেন । or “Q. I observe the stress which has been laid upon the approbious term Banyan applied to him, which is not applicable to him if used in the same sense by which the Common brokers in this place are distinguished under that application.
