It shall not be lawful for any person within the territorics to which this Act applics, to cultivate plants, from Prohibition of unlicensed cultivation us plants producing iutoxicating "rugs, und uf abetinent of the name, which intoxicating drugs are produced, without a license from the Collector of the district in which such plants are cultivated ; and any person who shull so cultivate, or in any way cause, encourage, or promote such illegal cultivation, shall be liable to a sinc not exceedin. five hundred rupees ; and the plant so cultivated shall be liable to seizurg and confiscation. 14. When any person is sentenced to pay any fine or forfeiture under thc s;uid Act XI of 1849, or the said Act XXI of 1856, or under this Act, the Magistrate shall Inuplinunnient in default of payınıemt of fine. follow the provisions of sections sixty-seven sixty-eight, sixty-ninc. and scventy of the Indian Penal Code, in awarding a period of imprisonment in default of payment thereof. Any such fine or forfeiture shall be recoverable in the manuer prescribed by section three hundred and seven of the Code of Criminal Procedure. 15. Notwithstanding anything in this or in any other Act contained, it shall be lawsul for the Licutenant-Governor, with the sauction of the Gover Licutenant-(ityvernor may assign to any Muiuri inlity the granting of 岚《冕山梅呜。 nor-General in Council, to assign to thc Justices of the Peace for the Town of Calcutta, or to any other Municipality, such functions and powers as he shall think fit in respect to the granting, withholding, and withdrawal of licenses for the sale of spirituous or serinciitcd liquors and intoxicating drugs (hting functions and powe:s which, but for such assignment, might legally be exerciscil by any officer of Government), ' , be cxercised by such Justiccs or by such Municipality within the limits of their respective jurisdictions under such conditions and subject to such rules us the sail Lieutenant-Governor luay impose; and the Lieutenant Governor inay at any time withdraw and revoke any functions and powers which he has assigucd under the provisions of this section. Provided that such functions and powers shall not be assigned us afurosaid without the conscnt of the said Justiccs or the Municipality couccrucd: [Government Gazette, 15th February 1876.] ( રે 8 ) ●iएंaञ श्रशTiग्न ! সাধারণ বিধি । cग थिब्नाग्न भाझकझटवrie.°fiणक गंizझट्र চাষ হইয় থাকে কোন ব্যক্তি সেই জিলার কালেকটর সাহেবের স্থানে লাইসেন্স ' না লইয়1. এই আইন যে২ দেশে প্রচলিত হয় সেই২ vদশের অন্তর্গত কোন স্থানে ঐ গাছের চাষ করিতে পাপ্লিবে না, কাম ব্যক্তি লাইসেন্স না পাইয় তাহা করিলে, কিম্বা কোন প্রকারেই সেই গাছের অবৈধমতে চাষ করাই.ল fক অন্যকে করিতে উৎসাহ কি প্রৱত্তি দিলে তাহার পণচ শত টাকার অনধিক অর্থদণ্ড হুইরে, ও ড ক্রমতে উৎপন্ন গাছ ক্রোক ও জব্দ হইতে পারিখে ইতি । ১৩ ধারা । লাইসেন্স ৰিনা মাদক মুদ্রব্যেt =পাদক গাছের চাষ করিবার ও ভাই সহায়তা কলবার দণ্ডের কথা । ১৮৪৯ সালের উক্ত ১১ আইন কিম্বা ১৮৫৬ সালের উক্ত ২১ আইন কিম্বা এই আইনমতে কোন ব্যক্তির অর্থ কি সম্পত্তি দণ্ডের অঙ্কিা হক্টলে, ও সেই দণ্ডের টাকা ন fদলে, তৎপরিবৰ্ত্তে তাছার যত দিন কারাদণ্ড হইবে মাজিষ্ট্রেট সাহেব ইহার আজ্ঞা করিতে গেলে ভারত4ষীয় দণ্ড বিধির আইনের ৬৭, ৬৮, ৬৯ ও ৭০ ধারার বিধানম:ত ক'ম করিবেন । ঐ অর্থ দণ্ডের কি সম্পত্তি দণ্ডের টাকা ফৌজদারী মকদ্দমার কার্য্যfপ ধানের আt &নের ৩০৭ ধারার বিধানমঙে মাদায় হইতে প।fরলে ইতি `०8 *{iतृी | দণ্ডের টাকা না দিলে কারাদণ্ডের কথা । ১৫ ধ।রা । এই আইনে বা অন্য আইমে যাহা থাকুক ঐযুত লেস্টেনেন্ট গৰণৱ যুত লেপ্টেলেন্ট গবর্ণর गा८श्व कर्द्धक ८कान पूानि- ग[८श्व মন্ত্রিসভাধিষ্ঠিত মাসিপালিটির প্রতি লাইসেন্স ম্যবর জীযুত গবৰ্ণর জেনয়ল fদৰrর ক্ষমতা অর্পণ করিতে সাহেবের অনুমতিক্রমে পারিখার কথা । কলিকাতা মগরের শান্তিরক্ষক জটিসদের বা আর কোন মুrনিসিপালিটির প্রতি স্বীয় বিবেচনামতে উগ্র শরাব বা গজাল মদ ও মাদকদ্রব্য বিক্রয়ের লাইসেন্স দি ধার কি না দিবার কি ফিরিয়া লইবার ক্ষমতা ও শক্তি অপণ করিতে পারবেন। অর্থাৎ যে ক্ষমতা ও শক্তি এমনভাবে তাহাদিগকে দণ্ড ন হইলে গবৰ্ণমেন্টের কোন কন্তুপক্ষদ্বার) বিধি ক্রমে প্রকাশ করা যাইতে পারিত, তাহা সেই লেপ্টেনেন্ট গবর্ণর সাহেব যে২ নিয়ম ও বিধি প্রণয়ন করেন তদনুসারে উক্ত জষ্টিস সকল বা মুনিসিপালিটির দ্বারা আপন২ আধিপত্যের মধ্যে কাব্যকরণার্থে দিয়াছেন ও ঐযুত লেপ্টেনেন্ট গবর্ণর সাহেব ফোন সময়ে এই ধারামত আ পিন প্রদত্ত ক্ষমতা ও শক্তি বাতিল ও রহিত করিতে পারবেন। | পরম্ভ উক্ত ক্ষমতা ও শক্তি জষ্টিসদের বা মু্যনিসিপালিটির প্রতি র্তাহাদের সম্মত ৰিম। পূর্বোক্তমতে অপণ করা যাইবে মা । o
