( •s. conveyance (that is to say,) A covenant that notwithstanding any act or default done by the said Commissioners, they were at the time of the execution of such conveyance, under and by virtue of the provisions of this Act, possessed of the lands or promises granted thereby for an indefeasible estate of inheritance in fee simple, free from all encumbrances done or occasioned by them or otherwise for such estate or interest as therein expressed to be thereby granted free from encumbrances done or occasioned by them. And in order to raise money for defraying the expences incurred or to be incurred by the said Coinmissioners in carrying into estect the provisions of this Act or of Act No. of 184 , it is enacted, that it shall be lawful for the said Commissioners, aud they are hereby authorized, subject in each case to the approval of the Governor aforesaid to be significal in writing, to borrow and take up at interest on the credit of the rates, taxes and duties authorized to be made, levied and received by the said Commissioners from any person who shall be willing to advance the same, the sum and surns of money necessary for defraying the costs, churges and expences incurred or to be incurred by the said Commissioners in earrying imto effect with the least possible delay the provisions of this Act or of Act No of 184 , and for securing the repayinent of such sum or sums of unoney witH, such interest thereon as shall be agreed upon between the said Commissioners. and the person or persons lending or advancing the same, the said gommissioners inay mortgage and assign over the said rates, taxes, tolls and duties, or any part thereof to the person or persons who shall advance such muoney, or to a Trustee or Trustees on his or their behalf as security for the money so to be borrowed, together with interost upon the same, and no assessment, tax, toll or duty over which any such mortgage shall hu's: heen granted shall be repealed in whole or in part until such Inortgage shall be paid off, unless by the consent in writing of such luortgagee.
