Failing either of these, the other પucceeds.* - According to Jimétaráñana the barren and the widowed daughter succeed in default of heirs as fir as the daughter's son (See Coleb. Dá. bhá, p. 8l) : but aecording to 8ríkriw#pa Tarfá/ankćra, the great grandson in the male line succeeds in default of the daughter's son,after him succeed the son, grandson, and great grandson in the male line of the rival wife, then the barren and (childless) widowed daughters are entitled to inherit. În. p. 87. t In Colebrooke's translation of Srikrishna's summary of the settled order of succession to the strídhan, there is a separate section or paragraph treating of the order of succession to property given by a father at any time other than the wedding, but there is no mention as to what is the order of succession to property given by a father at the time of the wedding : it must therefore be inferred that, according to his translation, the order of succession to such property is the same as that to property received by a wo. man at her nuptials from any other person; but such is not the case. According to the doctrine as cur. rent in Bengal there is no distinction between the property given by a father to his daughter at the time of her wedding and that given by him to her at any other time; and accordingly there is but one order of succession to property given by a father (at any time whatever, ) which order is the same as that laid down in the said section of the translation. There is in the original a little (sanskrit) word api (also, even) added to the words ‘joutakátirikte' (besides, or, other than, the property given at the time of wedding,) which (opi) includes in the above section the order of succession to property given by the father at the time of wedding as well as that given by him at any other time: had this word (api) not been omitted in the translation, it would also have been of the same import; as the passage would then have been “in the case of property given by the father at a tine even other than that of the wedding,”, instead of “in the case of property given by the father at any other time than the wedding.” and thus it would have comprehended also the order of succession to the property given by the father at the time of wedding. The little word (api) above sluded to must have been inadvertently overlooked by that learned translator, or he would have made some remark upon the same: more especially as he clearly saw that in the Dáyakr aka, (which was respected by him in preference to all other Bengal autho. rities, and the author whereof is the same (Srikrishna) as 'that of the Aulninary in question,) the order of *uccession to property given by the father at the time of wedding is the . same as that to property given by him at any other time; that that order is separate from the rest (See W. Da Kra. Pp. 57,583) and that the word 'opi' is also used in the text of the Diyibhāga (the original of the *mmary in question,) where it is rendered by him by the word 'aven, which indicates that the order **uccession to property given by a father at his daughter's wedding is the same as to that which is *"on to her by him at any other time (See Coleb. Da'. bha. pp. 88, 100, and sopra, p. 800.)
