In his default, the woman's brother's son succeeds.” Vyav.ustha' For he presents oblations to the woman, and to her father and grandfather. Reason 475. Failing him, the son-in-law succeeds. Wynvahtha Since he presents oblations to his father-in-law and mother-in-law.” This order of succession must be assumed; and the mention of “a sister's son,' and the rest, (in the text of Prihasput cited,) was intended merely for an indication of the heirs, without *pecifying the order in which they succeed.--Colol, Dá. Prihaspati's text above quoted, propounds therefore merely the right of succession by the persons above mentioned, and is by no means intended to exhibit the order in which they succeed.–W. Da. Kra. In default of the sapiudas, the sakulyas (distant kinsmen connected by vyayastha family)t are heirs; after them the suminodaikas (persons allied by similar obla. tions of water,)+ succeed in the order of proximity.” 硬 The heirs to a stridhan as recognised by the Dáyaháya are as far as the wapindas to which have been added the sakulyas and somânodakas by Srikrishna in his commentary on the Diyabhāga, as well as in the Iliyakramasangraha; $ in the latter it has been morover laid down that persons descended from the same patriarch in the male line (samāna-prararas,) succeed in the same way as to the property of males.” The order of succession to a childless woman's stridhan in default of heirs as far as the sapindas, being established according to nearness of kin, just as to the property of males, that order is not inapplicable here. But if such order be followed in the succession to the stridhan, persons bearing the same family name (samānayotra) should bucceed before those descended from the same patriarch (samāna-jirarara,) inasmuch as they being descended from the same primitive stock as well as patriarch, are more nearly allied, and therefore prefer
