( & February, 1846, sold the decree with his right to the costs, for 150 Rupees, to the petitioner, who thereupon took out execution. The plaintiff then presented a petition to the effect that he had obtained a decree in another case against the same defendant for 2,179 Rupees, and prayed that the amount of costs due by himself on the non-suit might be taken as a set off in part, against the amount due by the defendant on the second decree. The Principal Sudder Ameen on the ground that the sale of the decree in the case of non-suit had been effected before the application for execution of the second decree, rejected"the plaintiff's petition. On appeal, the Judge was of opinion, that the purchase and sale between the defendant and the petitioner, of the first decree, was an act of collusion, with a view to defraud the plaintiff; and to compel payment by him of the costs on the nonsuit, notwithstanding his having subsequently obtained a decree against the defendant for a much larger amount; and he accordingly reversed the order of the Principal Sudder Ameen. The petitioner then appealed to the Sudder Dewanny Adawlut. The, Court concurred entirely with the Judge, and rejected the petition, leaving the Petitioner to his remedy against the defen dant.

I have the honor to annex, for your information and guidance, copy of a letter from the Under Secretary to the Government of Beugal, dated the 7th October last, with enclosure, being copy of a lèesolution passed in the Financial Department under date the 18th September last, with reference to certain subscriptions realized at Moorshedabad for the erection of Vernacular School Houses, and to observe with reference to the 4th Paragraph of tlie Government Orders of the 14th December, 1844, prescribing that buildings for the accommodation of such Schools are to be provided for by the inhabitants, and kept in proper repair, that subscriptions for such purposes when paid into a Government Treasury at the option of the subscribers, should be treated as subscriptions intended for a specific purpose and should be credited in your Treasury Account under the head of “Deposits” with reference to the orders of Government in the Education Department, dated the 2d October, 1844, annexed to Mr. Under Secretary Beadon's Circular letter of the same date, No. 21, printed in Appendix No. 1 to the General Report on Public Instruction for 1844-45.
